NYC suspects had 'terrorist encyclopedia,' police say

Police arrested a New York City couple in their apartment on Saturday after authorities investigating a credit card theft found a highly explosive compound, bomb-making manuals, a sawed-off shotgun and ammunition, officials said on Monday.

Morgan Gliedman, 27, and Aaron Greene, 31, are being charged with two counts of suspicion of criminal possession of a weapon, for the shotgun, court documents show.?

One sheaf of papers found in the apartment had a cover page that read "The Terrorist Encyclopedia," according to court documents.?

Greene has been arraigned and held without bail, according to a law enforcement official involved in the investigation, who was not authorized to discuss the ongoing investigation.?

Gliedman had not yet been arraigned on Monday morning, said a spokeswoman for Manhattan District Attorney Cyrus Vance Jr.?

Police went to the couple's Greenwich Village apartment Saturday to question Gliedman, the daughter of a prominent New York doctor, to investigate a credit card theft, according to a second law enforcement official.?

At the apartment, detectives discovered a plastic bottle containing seven grams of Hexamethylene triperoxide diaminean, or HMTD, court documents show.?

HMTD is commonly used in homemade bombs. The discovery prompted the evacuation of nearby buildings, the second source said.?

Police also discovered a cache of bomb-making manuals and handwritten notebooks containing chemical formulas, the second source said.?

Additionally, investigators recovered a 12-gauge Mossberg 500 shotgun, ammunition, nine high-capacity rifle magazines and a flare launcher, the second source said.?

Law enforcement officials said Gliedman was the son of Paul Gliedman, director of radiation oncology at Beth Israel Hospital in Brooklyn.?

Neither Gliedman nor his wife, Susyn Schops Gliedman, a Douglas Elliman realtor, returned calls for comment.?

Morgan Gliedman studied creative writing at The School of The Art Institute of Chicago, according to her Facebook page, which contains a photo of Gliedman outside a pink dressing room, posing in a black, scoop-neck sweater and red checkered skirt.?

Greene attended Harvard University in Cambridge, Massachusetts, according to the New York Post, which first reported the arrests.?

The newspaper quoted a law enforcement source as saying that Greene was an Occupy Wall Street activist whose political views were "extreme."?

Two spokesmen for Occupy Wall Street's New York chapter said they had no knowledge of Greene.?

Green Day to get back on road in March

NEW YORK (Reuters) - The members of Green Day said on Monday they will return to the road in March after the punk rock band canceled its fall club tour and postponed later dates as frontman Billie Joe Armstrong underwent treatment for substance abuse.

"We want to thank everyone for hanging in with us for the last few months," the band members said in a statement on their website. "We are very excited to hit the road and see all of you again, though we regret having to cancel more shows."

Armstrong, lead singer and guitarist for the Grammy-winning rock band, sought substance abuse treatment in September following an angry, guitar-smashing on-stage outburst in Las Vegas. The details of his addiction were never specified.

Armstrong, 40, added to the website posting with a note on Instagram, saying:

"Dear friends ... I just want to thank you all for the love and support you've shown for the past few months. Believe me, it hasn't gone unnoticed and I'm eternally grateful to have such an amazing set of friends and family.

"I'm getting better every day," he said. "So now, without further ado, the show must go on. We can't wait to get on the road and live out loud! Our passion has only grown stronger."

The tour will begin in Chicago on March 28, with dates in Pittsburgh, New York, Toronto and other cities up through April 12 in Quebec City.

The band said it would announce additional West Coast dates in early 2013.

Tickets for the postponed shows will be honored at the new dates, Green Day said. Tickets for canceled shows will be refunded at the point of purchase.

In November the band moved up the release date of "iTr?!," part of an ambitious trilogy of albums that marks their first collection of new music since 2009, to December 11 from its original date of January 15, in part to make up for the canceled and postponed dates.

The California-based punk rock band, formed in the late 1980s, has sold more than 65 million records worldwide and won five Grammys, including best alternative album for its 1994 major-label debut, "Dookie," and best rock album for "American Idiot" and "21st Century Breakdown."

The Beauty of International Comparative Law in Vietnam

Law students from The John Marshall Law School and Vietnam National University School of Law, and representatives from Vietnam Lawyers' Association

The amount of warmth and hospitality that we have been shown since we have arrived in Vietnam is almost awe inspiring given the short period of time that has passed since the U.S. war in Vietnam. Today we attended our first day of law study meetings in Hanoi, and we received the same warm greetings that we have received everywhere in the city. Our discussions of the day began at the Galaxy Law Firm where Professor Nguyen Khac Hai, Head of International Cooperation of Vietnam-American Law Center of the Vietnam Lawyers? Association, gave an overview of Vietnam?s penal code and criminal procedure code. Professor Hai informed us that the U.S.-Vietnam law study exchange was the first of its kind. This is the first time in the post-war relations between the U.S. and Vietnam that the Vietnamese government has invited a U.S. law school to its country to discuss the development of law and the legal system in Vietnam. Through our discussions, we learned about the impact of international human rights law in Vietnam?s legal development. We also had the opportunity to ask questions regarding comparative criminal laws and constitutional laws between Vietnam and the United States.

One interesting area of criminal law where we noted a stark difference is the sentencing limitations for juvenile offenders of serious crimes. Death penalty and life in prison for juveniles is treated very differently between the nations. Juveniles have long been protected against the death penalty and unusual punishment in Vietnam, while a constitutional debate has waged in the U.S. over what rights juveniles retain. Prior to the recent U.S. Supreme Court decision in 2005, states could impose the death penalty on juveniles at the ages of 17 and 18. Only recently has the U.S. made headway on juvenile justice, finally ruling that mandatory life sentences and the death penalty for juveniles are unconstitutional. Discussions with Professor Chu Hong Thanh, Deputy Secretary General of The Vietnam Lawyers? Association, and Professor Hai helped to illustrate the need to integrate the international human rights standards into the Vietnamese criminal justice system.

Comparative analysis of Vietnam?s Constitution

The Constitution of Vietnam has been revised four times since the Declaration of Independence of Vietnam, following the end of World War II.? The current version was adopted in 1992, and the last constitutional amendment was passed in 2001. There is a movement in Vietnam today to amend and streamline the Vietnam Constitution and to incorporate international human rights standards into the Constitution.? Scholars and lawyers in Vietnam are consulting legal scholars and experts from around the world to find ways of improving the Vietnam Constitution. The John Marshall Law School is also contributing to this process. For instance, Professor Thanh raised questions concerning effective constitutional provisions ensuring checks and balances between main branches of government. In our discussions today, John Marshall law students questioned the absence of judicial review which would allow the courts to invalidate unconstitutional legislation. Furthermore, the students recommended inclusion of a new Supremacy Clause that would recognize international treaties and humanitarian law as part of domestic law.? This is a great opportunity for The John Marshall Law School, and it is a great honor to work with the Vietnamese government to ensure full constitutional protection for the people of Vietnam.

Maine greets gay marriage with midnight weddings

PORTLAND, Maine (AP) ? After waiting years and seeing marriage rights nearly awarded and then retracted, gay couples in Maine's largest city didn't have to wait a moment longer than necessary to wed, with licenses issued at the stroke of midnight as the law went into effect.

Among them were Steven Bridges and Michael Snell, who held a commitment ceremony six years ago but made marriage official under state law with a simple ceremony.

"It's historic. We've waited our entire lives for this," said Bridges, a retail manager, who's been in a relationship with the Snell, a massage therapist, for nine years. Bridges, 42, and Snell, 53, wore lavender and purple carnations on black T-shirts with the words "Love is love."

With Snell's two adult daughters looking on, they exchanged vows in the city clerk's office after getting the first marriage license issued to a same-sex couple in Portland.

Voters approved gay marriage in November, making Maine and two other states the first to do so by popular vote. The law is already in effect in Washington state; Maryland's takes effect on Tuesday, the first day of 2013.

Gay marriage was already legal in New York, Connecticut, Iowa, Massachusetts, New Hampshire, Vermont and the District of Columbia, but those laws were either enacted by lawmakers or through court rulings.

The Maine Legislature had once approved same-sex marriage, but it was overturned by a statewide referendum three years ago, crushing couples who had already made wedding plans. Gay marriage supporters collected signatures to put it on the ballot again, and this time it was easily approved.

Gov. Paul LePage signed off on the certified election results on Nov. 29, so the new law was to go into effect 30 days from that date. In addition to gay marriage becoming legal, same-sex marriages in other states will now be recognized by the state of Maine.

Nobody knew exactly how many couples would be rushing to get their marriage licenses early Saturday. Falmouth joined Portland in opening at midnight. A handful of other communities including Bangor, Brunswick and Augusta planned to hold special Saturday hours.

In Portland, the mood was festive with the crowd cheering and horns sounding at midnight as Bridges and Snell began filling out paperwork in the clerk's office in Portland City Hall.

More than a dozen couples stood in line to wait their turn amid the festive atmosphere. There were free carnation boutonnieres and cupcakes, and a jazz trio played.

Outside City Hall, a couple hundred people cheered Snell and Bridges when they emerged newly married, breaking into an impromptu song, the Beatles' "All You Need is Love."

Donna Galluzzo and Lisa Gorney also planned a midnight wedding, and theirs had all the trappings. They dined Friday night with friends, and then took a limo to City Hall. They had their rings, flowers, wedding vows and a friend to perform the ceremony.

They ended up near the back of the line awaiting marriage licenses, but that didn't matter.

"We decided it's a historic day and we thought it would be awesome to be a small part of history, to say we got married on the first day it's legal," Galluzzo said.

Not everyone was getting married right away.

Suzanne Blackburn and Joanie Kunian, of Portland, were among those in line to get their license at midnight, but they didn't plan to wed immediately. One of their grandchildren wanted them to get married on Valentine's Day.

"I don't think that we dared to dream too big until we had the governor's signature," Blackburn said. "That's why it's so important, because it feels real."

Obama, Congress struggle toward fiscal cliff deal

On Friday President Barack Obama met with congressional leaders once again to try negotiating a budget deal. Obama said he walked away from the meeting 'optimistic.'

The end game at hand, the White House and Senate leaders took a final stab at compromise Friday night to prevent middle-class tax increases from taking effect at the turn of the new year and possibly prevent sweeping spending cuts as well.

"I'm optimistic we may still be able to reach an agreement that can pass both houses in time," President Barack Obama said at the White House after meeting for more than an hour with congressional leaders.

Surprisingly, after weeks of postelection gridlock, Senate leaders sounded even more bullish.

The Republican leader, Sen. Mitch McConnell of Kentucky, said he was "hopeful and optimistic" of a deal, adding he hoped a compromise could be presented to rank-and-file lawmakers as early as Sunday, a little more than 24 hours before the year-end deadline.

Said Majority Leader Harry Reid: "I'm going to do everything I can" to prevent the tax increases and spending cuts that threaten to send the economy into recession. He cautioned, "Whatever we come up with is going to be imperfect."

Officials said there was a general understanding that any agreement would block scheduled income tax increases for middle class earners while letting rates rise at upper income levels.

Democrats said Obama was sticking to his campaign call for increases above $250,000 in annual income, even though in recent negotiations he said he could accept $400,000.

The two sides also confronted a divide over estate taxes.

Obama favors a higher tax than is currently in effect, but one senior Republican, Sen. Jon Kyl of Arizona, said he's "totally dead set" against it. Speaking of fellow GOP lawmakers, he said they harbor more opposition to an increase in the estate tax than to letting taxes on income and investments rise at upper levels.

Also likely to be included in the negotiations are taxes on dividends and capital gains, both of which are scheduled to rise with the new year. Also the alternative minimum tax, which, if left unchanged, could hit millions of middle- and upper-income taxpayers for the first time.

In addition, Obama and Democrats want to prevent the expiration of unemployment benefits for the long-term jobless, and there is widespread sentiment in both parties to shelter doctors from a cut in Medicare fees.

The White House has shown increased concern about a possible spike in milk prices if a farm bill is not passed in the next few days, although it is not clear whether that issue, too, might be included in the talks.

One Republican who was briefed on the White House meeting said Boehner made it clear he would leave in place spending cuts scheduled to take effect unless alternative savings were found to offset them. If he prevails, that would defer politically difficult decisions on government benefit programs like Medicare until 2013.

Success was far from guaranteed in an atmosphere of political mistrust ? even on a slimmed-down deal that postponed hard decisions about spending cuts into 2013 ? in a Capitol where lawmakers grumbled about the likelihood of spending the new year holiday working.

Embodied Cognition: Our Inner Imaginings of the World Around Us Make Us Who We Are [Excerpt]

Starting as early as the 1970s, some cognitive psychologists, philosophers, and linguists began to wonder whether meaning wasn?t something totally different from a language of thought [Call it Mentalese, whichtranslates words into actual concepts: a polar bear or speed limit, for instance]. They suggested that?instead of abstract symbols?meaning might really be something much more closely intertwined with our real experiences in the world, with the bodies that we have. As a self-conscious movement started to take form, it took on a name, embodiment, which started to stand for the idea that meaning might be something that isn?t distilled away from our bodily experiences but is instead tightly bound by them. For you, the word dog might have a deep and rich meaning that involves the ways you physically interact with dogs?how they look and smell and feel. But the meaning of polar bear will be totally different, because you likely don?t have those same experiences of direct interaction.

??? If meaning is based on our experiences in our particular bodies in the particular situations we?ve dragged them through, then meaning could be quite personal. This in turn would make it variable across people and across cultures. As embodiment developed into a truly interdisciplinary enterprise, it found footholds by the end of the twentieth century in linguistics, especially in the work of U.C. Berkeley linguist George Lakoff and others; in philosophy, especially in work by University of Oregon philosopher Mark Johnson, among others; and in cognitive psychology, where U.C. Berkeley psychologist Eleanor Rosch?s early work led the way.

???? The embodiment idea was appealing. But at the same time, it was missing something. Specifically, a mechanism. Mentalese is a specific claim about the machinery people might use for meaning. Embodiment was more of an idea, a principle. It might have been right in a general sense, but it was hard to tell because it didn?t necessarily translate into specific claims about exactly how meaning works in real people in real time. So it idled, and it didn?t supplant the language of thought hypothesis [Mentalese] as the leading idea in the cognitive science of meaning.

???? And then someone had an idea.
???? It?s not clear who had it first, but in the mid-1990s at least three groups converged upon the same thought. One was a cognitive psychologist, Larry Barsalou, and his students at Emory University, in Georgia. The second was a group of neuroscientists in Parma, Italy. And the third was a group of cognitive scientists at the International Computer Science Institute in Berkeley, where I happened to be working as a graduate student. ?There was clearly something in the water, a zeitgeist. The idea was the embodied simulation hypothesis, a proposal that would make the idea of embodiment concrete enough to compete with Mentalese. Put simply:

  • Maybe we understand language by simulating in our minds what it would be like to experience the things that the language describes.

???? Let?s unpack this idea a little bit?what it means to simulate something in your mind. We actually simulate all the time. You do it when you imagine your parents? faces, or fixate in your mind?s eye on that misplayed poker hand. You?re simulating when you imagine sounds in your head without any sound waves hitting your ears, whether it?s the bass line of the White Stripes? Seven Nation Army or the sound of screeching tires. And you can probably conjure up simulations of what strawberries taste like when covered with whipped cream or what fresh lavender smells like. You can also simulate actions. Think about the direction you turn the doorknob of your front door. You probably visually simulate what your hand would look like, but if you?re like most people, you do more than this. You are able to virtually feel what it?s like to move your hand in the appropriate way?to grasp the handle (with enough force to cause the friction required for it to move with your hand) and rotate your hand (clockwise, perhaps?) at the wrist. Or if you?re a skier, you can imagine not only what it looks like to go down a run, but also what it feels like to shift your weight back and forth as you link turns.

???? Now, in all these examples, you?re consciously and intentionally conjuring up simulations. That?s called mental imagery. The idea of simulation is something that goes much deeper. Simulation is an iceberg. By consciously reflecting, as you just have been doing, you can see the tip?the intentional, conscious imagery. But many of the same brain processes are engaged, invisibly and unbeknownst to you, beneath the surface during much of your waking and sleeping life.? Simulation is the creation of mental experiences of perception and action in the absence of their external manifestation. That is, it?s having the experience of seeing without the sights actually being there or having the experience of performing an action without actually moving.

???? When we?re consciously aware of them, these simulation experiences feel qualitatively like actual perception; colors appear as they appear when directly perceived, and actions feel like they feel when we perform them. The theory proposes that embodied simulation makes use of the same parts of the brain that are dedicated to directly interacting with the world. When we simulate seeing, we use the parts of the brain that allow us to see the world; when we simulate performing actions, the parts of the brain that direct physical action light up. The idea is that simulation creates echoes in our brains of previous experiences, attenuated resonances of brain patterns that were active during previous perceptual and motor experiences. We use our brains to simulate percepts and actions without actually perceiving or acting.

??? Outside of the study of language, people use simulation when they perform lots of different tasks, from remembering facts to listing properties of objects to choreographing a dance. These behaviors make use of embodied simulation for good reason. It?s easier to remember where we left our keys when we imagine the last place we saw them. It?s easier to determine what side of the car the gas tank is on by imagining filling it up. It?s easier to create a new series of movements by first imagining performing them ourselves. Using embodied simulation for rehearsal even helps people improve at repetitive tasks, like shooting free throws and bowling strikes. People are simulating constantly.

??? In this context, the embodied simulation hypothesis doesn?t seem like too much of a leap. It hypothesizes that language is like these other cognitive functions in that it, too, depends on embodied simulation. While we listen to or read sentences, we simulate seeing the scenes and performing the actions that are described. We do so using our motor and perceptual systems, and possibly other brain systems, like those dedicated to emotion. For example, consider what you might have simulated when you read the following sentence... :

  • When hunting on land, the polar bear will often stalk its prey almost like a cat would, scooting along its belly to get right up close, and then pounce, claws first, jaws agape.

???To understand what this means, according to the embodied simulation hypothesis, you actually activate the vision system in your brain to create a virtual visual experience of what a hunting polar bear would look like. You could use your auditory system to virtually hear what it would be like for a polar bear to slide along ice and snow. And you might even use your brain?s motor system, which controls action, to simulate what it would feel like to scoot, pounce, extend your arms, and drop your jaw. The idea is that you make meaning by creating experiences for yourself that?if you?re successful?reflect the experiences that the speaker, or in this case the writer, intended to describe. Meaning, according to the embodied simulation hypothesis, isn?t just abstract mental symbols; it?s a creative process, in which people construct virtual experiences?embodied simulations?in their mind?s eye.

??? If this is right, then meaning is something totally different from [a given] definitional model ... If meaning is based on experience with the world?the specific actions and percepts an individual has had?then it may vary from individual to individual and from culture to culture. And meaning will also be deeply personal?what polar bear or dog means to me might be totally different from what it means to you. Moreover, if we use our brain systems for perception and action to understand, then the processes of meaning are dynamic and constructive. It?s not about activating the right symbol; it?s about dynamically constructing the right mental experience of the scene.

??? Furthermore, if we indeed make meaning through simulating sights, sounds, and actions, that would mean that our capacity for meaning is built upon other systems, ones evolved more directly for perception and action. And that in turn would mean that our species-specific ability for language is built up from systems that we actually share in large part with other species.

??? Of course, we use these perception and action systems in new ways. We know this because other animals don?t share our facility with simulation?The capacity for open-ended simulation is something much more human than ursine, not just in language, but pervasively throughout what we do with our minds. You can simulate what you would look like if you covered your nose with your hand, just as easily as you can simulate what you?d look like if you had two heads or if you had a pogo stick in place of your right leg. If simulation is what makes our capacity for language special, then figuring out how we use it will tell us a lot about what makes us unique as humans, about what kind of animal we are, and how we came to be this way.

??? One of the important innovations of the embodied simulation hypothesis?and one way in which it differs from the language of thought hypothesis [Mentalese]?is that it claims that meaning is something that you construct in your mind, based on your own experiences. If meaning is really generated in your mind, then you should be able to make sense of language about not only things that exist in the real world, like polar bears, but also things that don?t actually exist, like, say, flying pigs. So how we understand language about nonexistent things can actually tell us a lot about how meaning works.

??? Let?s consider the case of the words flying pigs. I?d wager that flying pigs actually means a lot to you, even without thinking too hard about it. Over the years, I?ve asked a lot of people what flying pigs means to them, informally. (One of the luxuries of being a university professor is that people tend to be totally unsurprised when you ask questions like How many wings does a flying pig have?) According to my totally unscientific survey, conducted primarily with the population of individuals with time on their hands and a beverage in their glass, when most people hear or read the words flying pigs, they think of an animal that looks for all intents and purposes like a pig but has wings. The writer John Steinbeck imagined such a winged pig and named it Pigasus. He even used it as his personal stamp. What do you know about your own personal Pigasus? It probably has two wings (not three or seven or twelve) that are shaped very much like bird wings. Without having to reflect on it, you also know where they appear on Pigasus? body?they?re attached symmetrically to the shoulder blades. And although it has wings like a bird, most people think that Pigasus also displays a number of pig features; it has a snout, not a beak, and it has hooves, rather than talons.

??? There are a couple things to draw from this example. First, flying pigs seems to mean something to everyone. And that?s important because there?s no such thing as an actual flying pig in the world. In fact, part of the meaning of flying pigs is precisely that flying pigs don?t exist. What all of this means, not to be too cute about it, is that the Mentalese theory that meaning is about the relation of definitions to real things in the world will only work when pigs fly.

??? Second, if you?re like most people, what you did when you understood flying pigs probably felt a lot like mental imagery. You might ask yourself, did you experience visual images of a flying pig in your mind? Were they vivid? Were they replete with detail? Of course, consciously experiencing visual imagery is just one way to use simulation?you can also simulate without having conscious access to images. But where there?s imagined smoke, there may be simulated fire. If you?re like most people, when you simulate a flying pig, you probably see the snout and the wings in your mind?s eye. You may see details like color or texture; you might even see the pig in motion through the air. The words flying pigs are not unique in evoking consciously accessible visual detail. The same is true for lots of language, whether the things it describes are impossible like flying pigs or totally mundane like buying figs or somewhere in between, like the polar bear?s nose.

??? Third, and I don?t expect that this occurred to you because it only became clear to me through my extensive research?flying pigs doesn?t actually evoke something of the genus Pigasus for everyone. For some people, flying pigs don?t use wings to propel themselves, but instead conscript superpowers. If your flying pig is of this variety?let?s call it Superswine?then it probably wears a cape. Maybe a brightly colored spandex unitard, too, with some symbol on the chest, like a stylized curly pig tail or, better yet, a slice of fried bacon. And what?s more, when it flies, Superswine?s posture and motion are different from those of winged flying pigs. Whereas winged flying pigs hold their legs beneath their body, tucked up to their bellies or hanging below them, Superswine tend to stretch their front legs out in front of themselves, ? la Superman.

??? I?ll be the first to admit that the respective features of Pigasus and Superswine are not of great scientific value or vital public interest in and of themselves. But they do tell us something about how people understand the meanings of words. People simulate in response to language, but their simulations appear to vary substantially. You might be the type of person to automatically envision Superswine, or you might have a strong preference for the more common Pigasus. We observe individual variation like this not only for flying pigs, but equally for any bits of language. Your first image of a barking dog might be a big, ferocious Doberman, or it might be a tiny, yappy Chihuahua. When you read torture devices, you might think of the Iron Maiden or you might think of a new Stairmaster at your gym. Variation in the things people think words refer to is important because it means that people use their idiosyncratic mental resources to construct meaning. We all have different experiences, expectations, and interests, so we paint the meanings we create for the language we hear in our own idiosyncratic color.

Digital reading rises, while books fade

Share of adult Americans reading an e-book jumps from 16 to 23 percent in a year, Pew survey finds, while traditional book reading falls from 72 to 67 percent.

A Pew Internet Research Center survey released Thursday found that the percentage of Americans aged 16 and older who read an?e-book?grew from 16 percent in 2011 to 23 percent this year. Readers of traditional books dropped from 72 percent to 67 percent. Overall, those reading books of any kind dropped from 78 percent to 75 percent, a shift Pew called statistically insignificant.

Those owning an?e-book?device or tablet jumped from 18 percent to 33 percent, with much of that increase coming from last year's holiday season, when millions received Kindles, Nooks and other e-readers as gifts.

Awareness that libraries offer digital texts grew from 24 percent to 31 percent.

The telephone survey of 2,252 people aged 16 and older was conducted from Oct. 15 to Nov. 10. It has a sampling error margin of plus or minus 2.3 percentage points.

Charles Durning: 1923-2012

Charles Durning, the real-life war hero and dependable character actor who starred in The Sting, Tootsie and most recently as Denis Leary's father on the firefighter drama Rescue Me, died Monday in his New York City home. He was 89.

Durning's longtime agent and friend Judith Moss told the Associated Press that the actor died on Christmas Eve of natural causes.

In a rare feat, Durning earned back-to-back supporting actor Oscar nominations in 1983-84. After being signaled out for playing a comically corrupt governor in The Best Little Whorehouse in Texas, he received another nom for his work as?a Nazi colonel in To Be or Not to Be, starring Mel Brooks and Anne Bancroft.

His other memorable movie roles included playing Dustin Hoffman?s surprised suitor in Sydney Pollack's classic comedy Tootsie (1982). He was a frazzled police lieutenant in Dog Day Afternoon (1975), the U.S. president in Twilight?s Last Gleaming (1977) and a formidable monsignor in Mass Appeal (1984).

He also appeared in two Coen brothers films: The Hudsucker Proxy (1994) and O Brother, Where Art Thou? (2000).

Long active on the stage, Durning won a Tony Award for his portrayal of Big Daddy in the Broadway revival of Cat on a Hot Tin Roof in 1990.

Also that year, Durning captured a Golden Globe for his role as ?Honey Fitz? Fitzgerald in the miniseries The Kennedys of Massachusetts, based on the book by Doris Kearns Goodwin.

He was nominated for nine Emmys, including, most recently, one for outstanding guest actor in a drama series for FX's Rescue Me.

Durning served as a regular on the?Linda Bloodworth-Thomason sitcom Evening Shade, having previously played with that series' star, Burt Reynolds, in the films Starting Over (1979) and Best Little Whorehouse. The show ran 1990-94 on CBS. He also did voice work for Family Guy and had a recurring role as a priest on Everybody Loves Raymond.

Resembling what one might envision as a grizzled cop, Durning excelled in congenial everyman roles and was a familiar character actor, if not household name. With his stocky frame, he played Santa Claus five times in TV movies, often invigorating the ?ho-ho? hum character with a curt edge.

He has a role in?Scavenger Killers, a crime thriller in which he stars with?Eric Roberts?and?Robert Loggia?and?which is scheduled to open next year.

Durning was born Feb. 28, 1923, in Highland Falls, N.Y. The son of an Army officer, he took classical dance lessons as a youth. Following high school, he served in the Army?s 1st Infantry Division during World War II. Durning was part of the D-Day invasion, winning a Silver Star and three Purple Hearts.

After his military discharge, he held several jobs -- elevator operator, ironworker, cab driver, dance instructor, boxer. He fought on the same card as another future actor, Jack Warden, in Madison Square Garden.?

While working as an usher in a burlesque joint, Durning was hired to replace a drunken actor on stage. He plowed into his new calling, performing in roughly 50 Brooklyn stock company productions and in various off-Broadway plays.

He attracted the attention of Joseph Papp: Beginning in 1962, Durning appeared in 35 plays as part of the New York Shakespeare Festival. During this period, he segued into TV, notching a stint as a police chief on the NBC soap opera Another World.

Durning made his film debut in 1965, playing in Harvey Middleman, Fireman. He also appeared in Brian De Palma?s Hi, Mom! (1971), credited as Charles Durnham.

In 1972, director George Roy Hill, impressed by his performance in the Tony Award-winning That Championship Season, offered Durning a role in The Sting. In the Oscar best picture winner starring Paul Newman and Robert Redford, Durning won distinction as a crooked cop.

His other film credits include Dick Tracy (1990) and V.I. Warshawki (1991).

On TV, Durning brought a beatific countenance to a number of exalted roles, including playing the pope in the 1987 telefilm I Would be Called John: Pope John XXIII. He starred as the title officer in the 1975-76 series The Cop and the Kid, played Studs Lonigan?s dad in the 1979 miniseries Studs Lonigan and was a private eye in the 1985 series Eye to Eye.

Durning also shined as a domineering industrialist in the 1989 telefilm Dinner at Eight, a role made famous by Wallace Beery in the 1933 film. He starred as a postman opposite lonely widow Maureen Stapleton in the wonderful Queen of the Stardust Ballroom in 1975 and played a baseball legend in 1981's Casey Stengel.

In 2008, the Screen Actors Guild gave Durning its Life Achievement Award, and he was honored with a star on the Hollywood Walk of Fame.

Survivors include his daughters Michele and Jeanine and a son, Douglas.

Gun control: Insurance policy | The Economist

It's an idea that seems to be gathering a bit of steam. At Forbes.com, John Wasik lays out the logic behind treating firearm deaths as a market externality to be compensated via insurance, as we do with cars: "Those most at risk to commit a gun crime would be known to the actuaries doing the research for insurers...?An 80-year-old married woman in?Fort Lauderdale?would get a great rate. A 20-year-old in inner-city Chicago wouldn?t be able to afford it. A 32-year-old man with a record of drunk driving and domestic violence would have a similar problem."?Robert Cyran and Reynolds Holding write that mandatory liability insurance is a measure that could pass Supreme Court muster where other restrictions might fail: "[T]here?s a strong argument that damage caused by firearms gives the government a 'compelling interest' to require insurance, the test for infringing a constitutional right."

The first objection that leapt to my mind was that given that 9,000 people per year are murdered with firearms in America, and that essentially every one of those killings entails a wrongful death that could be grounds for a suit, liability insurance for firearms might be so prohibitively expensive that no one would be able to afford it. But it looks like this probably isn't the case. The National Rifle Association already offers "excess personal liability and self-defence" coverage to its members, and according to their website it seems $100,000 worth of insurance costs just $165 per year; $250,000 worth is $254. That may seem too low a value to put on someone's life, but it's a lot better than nothing, and as Mr Wasik says, the private insurance market will likely do a very good job of discriminating between gun owners who pose different levels of risk.

This isn't a substitute for other popular gun-control measures, such as limitations on magazine capacity, universal background checks?(which even NRA members support) and so forth. But given the limitations on possible gun control measures in a country where the Supreme Court holds individual gun ownership for home self-defence to be a constitutionally protected right, and where there may be 300m firearms already in circulation, it seems like a good place to start. For that matter, there's no reason why we should wait for the federal government to impose these policies. States with strong pro-gun-control politics could start passing mandatory firearm-insurance laws right now. Apparently an effort to do so in Illinois in 2009 ran aground due to opposition from gun organisations and right-wing media, but the politics of the issue would probably be rather different today.

SAfrica: Children attend Mandela's Christmas party

MVEZO, South Africa (AP) ? A couple of decades ago, Nelson Mandela grew withdrawn while feasting with his family on Christmas Day in the part of rural South Africa where the anti-apartheid leader lived as a child. Alarmed by the patriarch's silence, some relatives looked at him and asked if anything was wrong.

"'I'm just wondering what the rest of the community is doing while we're having a huge meal,'" Mandela said at the time, according to his grandson, Mandla.

Family members immediately canvassed the neighborhood for children to join their party, rounding up a merry band of 60, and so began an annual tradition that ballooned in popularity. A scaled down version was held Tuesday in Mvezo, Mandela's birthplace, drawing hundreds of local children to a celebration whose 94-year-old founder could not attend because he is in hospital care.

President Jacob Zuma, meanwhile, joined Mandela's wife, Graca Machel, and other family members to wish a Merry Christmas to Mandela at his hospital bedside in Pretoria, the South African capital.

"We found him in good spirits," Zuma said in a statement. "He shouted my clan name, Nxamalala, as I walked into the ward! He was happy to have visitors on this special day and is looking much better. The doctors are happy with the progress that he is making."

Mandela was admitted Dec. 8 to a hospital. He was diagnosed with a lung infection and also had a procedure to remove gallstones. Officials have previously said Mandela was improving, but note doctors are taking extraordinary care because he is very old.

In Mvezo, it was a rainy day, but the 800 children attending the Mandela party were happy to sweep up sunglasses, dolls, toy cars, blankets and other gifts. They cavorted and whooped under a big tent. Loud music livened the moment. One little girl, however, didn't get her wish.

"I wish to see Tata Mandela back home to have Christmas with us," said 4-year-old Babalwa Booi. "Tata" means father in South Africa's Xhosa language.

"This is a special day to us mainly because of the lessons drawn from my grandfather," said Mandla Mandela, a tribal chief in the Mvezo area of Eastern Cape province.

The genesis of the homegrown Christmas party is one more entry in the voluminous lore about Mandela's generosity and openness of spirit, which he even extended at times to the jailers who imprisoned him for 27 years under apartheid.

The system of white minority rule was eventually dismantled, opening the way to South Africa's first democratic elections in 1994. Mandela, a Nobel laureate, served one five-year term as president before retiring and in recent years he has lived near Mvezo in Qunu, a village where he recalled happy moments as a child.

Mandela himself was uneasy with the idea of being an icon, and as president, he failed to craft a lasting formula for overcoming South Africa's biggest, post-apartheid problems, poverty and economic inequality. While he was active, he did not escape criticism as an individual and a politician, but he is globally respected as a symbol of decency and principle.

Mandla Mandela, the grandson, remembered how the Christmas party that followed the first impromptu one in the 1990s was swamped by more than 1,000 children, three times as many as were expected. By 2001, nearly 10,000 were showing up. At some point, the chief said, American television personality Oprah Winfrey got involved and there was sponsorship.

"The numbers grew phenomenally," he said, with tens of thousands of children in attendance.

The Christmas parties were originally held in Qunu. The 2005 edition was cancelled when Mandla Mandela's father died. The tradition was revived in 2007 in Mvezo.

Nelson Mandela "has always said every society will be judged by the manner it treats its children," his grandson said.

"We were, on our part, wishing to spend this time with him, Christmas being a family day," his grandson said. "But we do not want to exert pressure on the doctors because they know what he needs to get well."

    Jupiter, Moon Align in Christmas Skywatching Treat

    As darkness falls on Christmas night, check out the east-southeast sky.?Shining brilliantly to the upper left of the bright, nearly full moon will be a silvery "star" with a steady glow.

    But that's not a star, or Santa returning to the North Pole. Rather, it's the largest planet in our solar system, Jupiter, serving as a sort of holiday ornament with Earth's nearest neighbor to cap off a year of interesting skwyatching events. ??

    As viewed from the eastern and central United States, the moon and Jupiter will appear closest together during the late afternoon or early evening hours on Tuesday (Dec. 25). From New York, they?ll be closest together at 6:25 p.m. EST (2325 GMT); from Chicago, it?ll be 5:18 p.m. local time (2318 GMT).

    Jupiter will appear just a bit over one-half degree from the limb of the moon. (One-half degree is roughly equal to the moon?s apparent width). In the western United States, the closest approach will come before sunset, but moon and planet will still appear to be quite close together as darkness falls.?[Video: Jupiter and the Moon Converge on Christmas]?

    The pair will be slowly separating as Tuesday night shifts to Wednesday morning; the moon moves across the sky at roughly its own diameter each hour.?

    Jupiter will remain a bold light high in the east-southeast at nightfall.?This week, it?doesn't set in the west until around 5 a.m. local time.?Appearing brighter than any nighttime star, Jupiter is now levitating in front of the constellation Taurus (the Bull), not far from the famous V-shaped Hyades star cluster and despite the nearby presence of the orange 1st-magnitude star, Aldebaran, which fills this region of the sky with overbearing brightness.?

    What kind of telescopic observation can be made of the gas giant now??Almost every kind.?From mid-northern latitudes you can even watch a full rotation of Jupiter, with the cloud features of every longitude displayed, during a single nightlong vigil. And as always, a fascinating dance of Jupiter's four large Galilean satellites will await viewers on any night who watch with a small telescope or even steadily held binoculars.

    As darkness falls over the eastern U.S. on Tuesday, you'll see two Jupiter moons ? Ganymede and Callisto ? on one side of the giant planet, while?a third, Europa, hovers by itself on the other side.?

    As the evening progresses, Ganymede and Europa will gradually pull away from Jupiter. Then, at 7:15 p.m. EST (0015 GMT Wednesday), the fourth Galilean satellite, Io, will emerge from Jupiter's shadow and appear on the side of the planet occupied by Europa.?

    Slowly, as Tuesday night wears on, Io will become easier to see as it moves away from Jupiter and toward Europa. At 11:40 p.m. EST (0440 GMT Wednesday), you?ll see Io passing Europa.?

    And Jupiter itself will continue to be a great target throughout the entire winter season for those who got binoculars or a telescope as a holiday gift.

    One in US, one in Russia: Young brothers divided

    This Christmas, the best gift 7-year-old Jack Thomas could get would be the arrival of his little brother, Nikoly, who lives in an orphanage in Kursk, Russia.

    "When Jack is asked about his family, he talks about his brother," said his father, John Thomas, speaking from the family?s home in Minnetonka, Minn. "He always asks, 'When is he coming home?' We just tell him we?re waiting for the call."

    Jack has been waiting several years, a long time for a little boy. What he doesn?t know is that a feud between politicians in Moscow and Washington could destroy his chance to grow up with his brother.

    On Friday, Russian lawmakers passed a bill that would prohibit Americans from adopting Russian children, and if that bill is signed into law by President Vladimir Putin, it would cast doubt on even those adoptions already in the pipeline.

    For John Thomas and his wife, Renee ? and very likely hundreds of other expectant American families and Russian children ? the latest political shift could mean?a delay, a new hurdle or a brick wall.


    The?U.S. State Department and some high-level officials in Moscow have lambasted the legislation as punishing Russian children?who need families in an effort to retaliate against Washington.

    But the bill has gained ground amid a wave of nationalism, fueled by anger over a U.S. human rights bill singling out Russia and by several highly publicized?cases of U.S. adoptions that ended tragically.

    Since the end of the Soviet era in 1991, Americans have adopted about 60,000 children from Russia, making it one of the main countries of origin for non-domestic adoptions in the United States, according to U.S.?government statistics.?At the?peak of the trend in 2004, Americans brought?5,862 children into their homes. In 2011, the number was down to 962 ? a product of well-intentioned policy shifts, bureaucracy, corruption and other difficulties.

    European Children Adoption Services

    Jack Thomas, at the age of 3, just before he was adopted from Kursk, Russia, by Americans John and Renee Thomas. He is now 7 years old and growing up in an affluent suburb of Minneapolis.

    Even with foreign adoptions, which are allowed after giving Russians priority, Russia has an estimated 700,000 children living in institutions, nearly 80,000 of them orphaned, and the rest abandoned or taken away by the state because the parents were judged unfit to take care of them.

    The?Thomases have experienced the painful, stop-start nature of the Russian adoption process in their quest for Nikoly.

    It was in December 2008, when they were finalizing their adoption of 3-year-old Eduard, whom they named Jack, that they learned he had a baby brother. They started the adoption application process for Nikoly as soon as they could, after a required waiting period.

    A year later, John and Renee Thomas, who work as an attorney and a building contract negotiator, again flew to Moscow and then went by rail to Kursk to meet Nikoly, whom they call Theodore or Teddy. He was?18 months old. Renee Thomas says she thought it would take about the same amount of time to adopt him as it had with Jack, and expected to travel to Kursk sometime in the spring of 2010 to get him.

    The Thomases?are?still waiting.

    One of the reasons for delay, they say,?is the horror caused by a woman in Tennessee who put her 7-year-old son, whom she had adopted in Russia, on a one-way flight to Moscow in 2010, with the explanation that the child was "mentally unstable" and she could no longer take care of him.

    In another delay that Renee Thomas believes cost their adoption another year, the Russian government shut down adoptions for review and re-accreditation of all adoption agencies that work in Russia.

    In addition, the Thomas? dossier has gone before a series of judges in Russia, some of whom have rejected it without a stated reason, and others setting forth requirements that they are not able to meet under U.S. law. Even so, there are Russians trying to help them run the gauntlet, and they figured the problems would get ironed out.

    "We expected to be traveling soon" to get Nikolai, said John Thomas. ?

    Just last month, when a newly negotiated bilateral adoptions agreement came into effect, designed to smooth out the process and help safeguard adopted children, things appeared to be looking up.

    "These adoptive parents have really been through the ringer," said Johnson. "This was a bilateral treaty signed by our two governments. We really celebrated it. I thought we could turn our attention to other countries. But we?re really back to Russia again."

    Kids pay in human rights spat
    The ban that passed the Russian parliament grew out of a dispute over human rights.

    On Nov. 16, the Sergei Magnitsky Rule of Law Accountability Act passed by a landslide in the U.S. House and Senate. Magnitsky was a 37-year-old lawyer who exposed massive fraud allegedly committed by a group of Russian officials. He was arrested and died in police custody 11 months later under suspicious circumstances. Among other things, the bill denies visas and freezes assets of the Russian officials implicated by Magnitsky.

    The new U.S. law sparked an angry reaction from Moscow and fueled popular anti-American sentiment.

    Russian President Vladimir Putin claims the U.S. is "poisoning ties" between the two countries with a law that bans Russians who abuse human rights and is backing a Russian draft law banning adoption by Americans. NBCNews.com's Dara Brown reports.

    Vladimir Putin said that the law singling out Russia "contaminates our relations."

    Russian legislators then drafted a bill to counter the U.S. law, with provisions restricting organizations and individuals linked to the United States.

    Just before the first vote in the Duma, the proposed ban on American adoptions of Russian children was tacked on as an amendment. The legislation was named after 21-month-old Dima Yakovlev, a Russian boy who died in Virginia after his adoptive father left him alone in a hot SUV for nine hours.

    Americans may lose right to adopt Russian kids

    After the Duma approved the legislation on Friday, the U.S. State Department registered its disapproval.

    "If Russian officials have concerns about the implementation of (the adoption) agreement, we stand ready to work with them to improve it and remain committed to supporting inter-country adoptions between our two countries," said acting State Department spokesman Patrick Ventrell. "The welfare of children is simply too important to be linked to political aspects of our relationship."

    The bill is now heading for Putin?s desk for his signature.

    Opponents of the ban are still hoping that the president will veto the bill, despite his comments while campaigning for re-election that?U.S. adoptions should no longer be allowed. More recently he has remained silent on the issue.

    Over the past week, Russian opponents of the ban have launched petitions and small protests at the parliament building, and several high-level officials have registered strong opposition to it, including Russia?s foreign minister and education minister.

    Johnson of the National Council for Adoption says he?s hoping the domestic opposition will dissuade Putin from signing the adoption ban into law.

    "One good thing that?s happening ? is a movement brought on by Russian citizens and the foreign minister who has spoken out against this legislation ? saying it?s not the right way to stick it to America,? he said. "Hopefully more politicians will feel comfortable speaking out."

    Barring that, he said, he hopes Russia will at least make provisions to finalize the adoptions that are already in process.

    "There is a precedent ? to negotiate pipeline cases," he said, citing examples in Guatemala and Kyrgystan. "But given the animosity that Russians feel towards this, I hope that?s not a conversation we have to have."

    For the Thomases,?despite politics, the adoption effort is now in overdrive. They understand that Nikoly, who turned 4 in June, could be moved at any time ?? and in fact may have been moved already to a Russian institution for children as old as 18.

    "That's major," said John Thomas. "That's where bad things start to happen."

    For Renee Thomas, her greatest fear is that the boys will not be allowed to grow up together.?But she tries to stay positive for Jack.

    "????This morning as I was making him breakfast, he said 'Mom, wouldn't it be great if we woke up Christmas morning and Santa left presents and Teddy under the tree?' My response was 'Let's hope for next year.'"
